Documents you need to rent a flat in India: tenant and landlord checklist

What to ask for, what to hand over, and what to keep, so the agreement holds up and your HRA claim goes through.

The right documents do three jobs. They prove the person renting to you actually owns the flat. They make your agreement enforceable if something goes wrong. And they let you claim HRA and prove your address for a bank account, a gas connection or a passport.

Here is the full list, who provides each one, and why it matters.

Check that the owner is the owner

The most expensive rental mistake is paying a deposit to someone who does not own the flat: a previous tenant subletting, a caretaker, or a scammer with photos copied from a listing site.

  • Ask to see the sale deed or a recent property tax receipt, and match the name with the owner's ID.
  • If you are dealing with a family member or an agent, ask for a letter of authority from the owner.
  • Pay the deposit and rent only to the owner's own bank account, never to a third party.

The rental agreement

Most Bangalore agreements are for 11 months, printed on e-stamp paper, signed by both sides and two witnesses, and often notarised. A lease longer than a year has to be registered at the sub-registrar's office. Our guide to tenant and landlord rules lists the clauses it should contain.

Read the last page first

House rules hide at the end: no non-vegetarian cooking, no guests after 10 pm, no pets, a painting charge. If a rule is a deal-breaker for you, find it before you pay anything.

Rent receipts and HRA

  • Ask for rent receipts with the amount, the period, the address and the owner's signature.
  • If your rent is more than ₹1 lakh a year (more than about ₹8,300 a month), you need the owner's PAN to claim HRA.
  • Pay rent by bank transfer or UPI. The bank record backs up your receipts.
  • Your employer may ask for the agreement and more details of the owner. Keep a scanned copy ready.

What to keep, and for how long

Keep a folder (paper and a phone scan) with the agreement, the deposit receipt, the inventory list, your move-in photos and video, rent receipts and the owner's ID copy. Keep it until your deposit is back in your account, and keep the rent receipts until your tax assessment for that year is done.

Questions people ask

Is police verification compulsory for tenants in Bangalore?

Many owners and apartment societies in Bengaluru ask for it, and it is a good idea for both sides. Ask the owner or the society how they want it done.

Do I need the landlord's PAN to claim HRA?

Yes, if your rent is more than ₹1 lakh in the financial year. Below that, rent receipts and the agreement are usually enough.

Does the agreement need to be registered?

Only if the lease is for more than a year. Most Bangalore agreements are for 11 months on e-stamp paper for that reason.
